1. Introduction

The general sales and delivery conditions exclusively govern the contractual relations on the websites www.radicaldesign.com, www.radicaldesign.nl, www.radicaldesign.de and www.radicaldesign.fr(hereinafter referred to as the "Site") between the Visitor or Buyer (hereinafter referred to as "You") and the Host or Seller Radical Design (hereinafter referred to as "RD"), belonging to the company Radical Design Manufacturing BV, located at Hoofdstraat 8, 9514 BE Gasselternijveen and registered with the Chamber of Commerce of Meppel under number 01123237.

The general sales and delivery conditions are the only conditions applicable and replace all other conditions, unless otherwise agreed in writing and signed by both parties. Both parties accept these conditions without reservation.

RD has the right to modify specific provisions of these general sales and delivery conditions. It is therefore important to reread them each time you visit the site.

RD assumes that by validating an order, you unreservedly accept these general sales and delivery conditions after having read them. By placing an order on the Site, you accept the applicability of these general sales and delivery conditions.

The nullity of a (part of a) clause does not affect the applicability of the rest of these general sales and delivery conditions. Instead of the null clause or the invalid part, the relevant legal provisions apply.

These general sales and delivery conditions are drawn up to protect your rights as a customer and RD as a supplier.


2. Ordering

You can place your order via our webshop: www.radicaldesign.com

To place your order, follow the following 4 steps after adding the desired items to your shopping cart:

  1. Fill in your personal details.
  2. Accept the general sales and delivery conditions by checking the corresponding box.
  3. Choose the payment method.
  4. Complete the payment, thereby finalizing your purchase agreement with RD.
  5. You will receive an order confirmation by email. Please check it carefully for errors. Immediately report any errors by email to info@radicaldesign.com

You can cancel your order free of charge as long as it has not been shipped to you. This can be done by phone at +31 599 513482 or by email to info@radicaldesign.com.

3. Product information

RD takes great care in providing online information about the characteristics of the products, including technical descriptions and illustrative photos, within the limits of technical possibilities. The photos may differ from the actual product sent, so the photos are not binding.

Any offers are valid while stocks last.

The product photos on this website are protected by copyright and may not be reproduced, distributed, or used for other purposes without our express written permission.

4. Prices

Sales prices

The sales prices listed on the site include VAT but exclude shipping costs and customs duties for countries outside the European Union. Any shipping costs are at your expense and will be calculated at the end of the order, on top of the price of the selected products. We reserve the right to change prices at any time, but we undertake to apply the product price listed on the site at the time of your order for that product.

Sales prices outside the EU

All our prices are the same for delivery addresses within and outside the European Union. The price for delivery within the EU includes 21% VAT, while the price for delivery outside the EU contains 0% VAT. This is because we only charge €15 for shipping outside the EU, while the actual costs are much higher. Additionally, it takes us considerably more time to process a shipment outside the EU due to the required documentation. To keep it simple for both us and the customer, we have chosen to use one price for all destinations on the entire website. This means that no VAT can be reclaimed for deliveries outside the EU.

Price exception for Switzerland, Norway, Iceland and UK

For deliveries to Switzerland (CH), Norway (NO), Iceland (IS) and United Kingdom (UK), we make the following exception: for orders valued at more than €250, we can deduct 21% VAT upon request and increase the shipping costs to €50. This reduces the final price for the consumer, and we also list this price on all customs and invoice documents with the shipment. The price difference will be refunded to your account. This exception has been in effect since 2017 (Iceland 2018) and does not apply to previous purchases.

5. Availability

We process your order based on available stocks. If a product ordered by you is not in stock, we will contact you to inform you of the expected delivery date or to offer you a suitable alternative.

6. Payment

You can pay via various payment methods, including iDEAL, PayPal, credit card (Visa or Mastercard), bank transfer.

Multisafepay:

After placing your order, you will be redirected to your bank's website. To pay the invoice amount via multisafepay, you must have a bank account suitable for online banking, verify yourself, and confirm the payment instructions to us. You will receive further instructions during the ordering process. The payment transaction is then executed immediately, and your account will be charged.

PayPal:

During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, verify yourself with your login data, and confirm the payment instructions to us. After placing your order in the store, we ask PayPal to initiate the payment transaction. The payment transaction is then immediately executed by PayPal. You will receive further instructions during the ordering process.

Credit card:

When placing your order, you provide your credit card details. After verifying you as the legitimate cardholder, the payment transaction is automatically executed, and your card is charged.

Bank transfer:

When choosing the payment method "Bank transfer," we will provide you with our bank details in a separate email, and we will deliver the goods upon receipt of payment.

Payment by card upon collection:

You pay the invoice amount with your debit card or bank app when collecting the goods.

7. Retention of title

The goods remain our property until they are fully paid for.

8. Shipping and delivery

RD aims to ship your order within 1 to 3 business days after receiving payment. The delivery time may vary depending on the destination country and the shipping company. More information about estimated delivery times can be found on our website.

9. Transport Damage

If goods are delivered with obvious transport damage, you should report such defects to the deliverer as soon as possible and then contact us immediately. This helps us to make our own claims against the carrier or transport insurance.

10. Return Policy

Purchased Items

If you are not satisfied with your purchase, you can return the product within 14 days of receipt. The product must be unused and in its original packaging and with the original labels. The costs of returning are at your expense unless the product is defective or delivered incorrectly.

• Shipping from outside the EU (worldwide) to the Netherlands: Please note that any additional customs costs (VAT) are at your expense.

If you exercise your right of return, RD will refund the purchase amount within 14 days after your claim for return. However, we reserve the right of 3 days for inspection of returned products upon receipt. You will be refunded in the same manner as the payment was made.

A return shipment must be sent by post or a similar carrier. We recommend sending your order by registered mail and taking out insurance with the carrier, covering the market value of the products. This is in case of theft or loss of the products during transit.

Rental Items

Upon return, the rented carts must be in the same clean condition as received, including the original box. Ensure that sand, crumbs, and hairs are removed to avoid additional cleaning costs of €45. We advise you to send your return shipment by post or a similar carrier. It is advisable to send the shipment by registered mail and to insure it with the carrier for the market value of the rented carts. This protects you in case of theft or loss of the carts during transport. In case of loss or damage during shipping or return, please contact us immediately. Once we receive your return shipment, we will refund the remaining amount of the deposit within 7 days. However, we reserve the right to inspect returned products within 3 days of receipt. The refund will be made in the same manner as the payment.

Non-delivery

If you are not present during delivery and the package is returned to us, the responsibility lies with the buyer. The buyer is also responsible for the costs arising from re-shipping the package. Ensure that the delivery address is accurate and keep track of the tracking information for delivery status.

Responsibility

After Shipment Once the package leaves our building and is handed over to the delivery service, we are no longer responsible for any loss, damage, or delays that may occur during the shipping process. We strive for safe and reliable shipping, but we advise buyers to inspect the contents of the package upon receipt and to report any concerns directly to the delivery service.

9. Warranty and after sales service

Legal Warranty

All sold products are covered by the legal warranty regarding conformity and hidden defects.

You have two months from receipt of the product to notify RD of its non-conformity. You have five years from receipt of the product to notify RD of hidden defects. After these periods, RD accepts no liability for consequences of non-conformity or hidden defects.

Whatever the problem, when returning the product, you must always include a copy of your invoice and a printed version of our return confirmation email.

The costs of returning a product are borne by the buyer. However, if an item is returned under the conformity warranty, the shipping costs will be refunded to you. You can return a product to us by Post or a similar carrier. RD will then take care of any repairs that may be necessary.

The legal warranty is not or only partially applicable to repairs necessitated by external causes (e.g., dropping, accident, etc.), use not in accordance with our specifications, use detrimental to the normal functioning of the product, or commercial or communal use.

RD Warranty

RD provides a 5-year limited warranty against hidden defects and material faults for all sold products. Normal wear and tear, zippers, coatings applied to fabrics, and damage caused by an accident by you or by a third party, or as a result of harmful, highly intensive, abnormal, or non-conforming use of the product are excluded from the warranty.

RD will determine whether damage falls under its warranty and whether the product qualifies for replacement or repair.

If damage does not fall under the above warranties, RD will provide you with a quote for repair or replacement. Repair or replacement will take place after acceptance of the quote and prepayment of the repair or replacement of the product. Administrative costs may be charged if you do not pay the quote. *See General Warranty

10. Responsibility

RD cannot be held responsible for incorrect use of its products. Even though they perform as professional products, the products offered on our webshop are intended for private use.

11. Product repairs

12. Complaints

For complaints about our products or services, you can contact us via info@radicaldesign.com. We will do our best to resolve your complaint as soon as possible.

Applicable Law and Dispute Resolution

Dutch law applies to these general terms and conditions of sale and delivery. In the event of a dispute, we will do our best to reach an amicable settlement. If this is not possible, disputes can be submitted to the competent court in the Netherlands.

Out-of-court Dispute Resolution (for consumers only)

If you are a consumer residing in the European Union, you can use the European Commission's online dispute resolution platform, which you can find at https://ec.europa.eu/consumers/odr/. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
