The general terms and conditions of sale detailed below only govern the contractual relationship undertaken on the Websites www.radicaldesign.com, www.radicaldesign.nl, www.radicaldesign.de and www.radicaldesign.fr (hereafter referred to as “Website”) between the Visitor or Buyer (hereafter referred to as “You”) and the Host or Seller Radical Design (hereafter referred to as “RD”) belonging to the company Radical Design Manufacturing BV, whose headquarters are situated at Hoofdstraat 8, 9514 BE Gasselternijveen, Netherlands and registered on the Register of Companies and Commerce in Meppel under the number 01123237.
These general terms and conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. Both parties accept these conditions unreservedly.
RD maintains that, by confirming your order, you unreservedly accept our general terms and conditions of sale, having read them.
These general terms and conditions of sale are important to you and RD as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.
The invalidity of one (part of) a clause does not affect the rest of applicability of these general terms and conditions of sale. Instead of the invalid clause or invalid part the relevant statutory provisions apply.
RD reserves the right to change specific parts of these general terms and conditions of sale. Therefore it is necessary to reread them during each visit of the Website.

The Website ordering process consists of 4 easy steps. Once you have chosen the products you would like to buy and have confirmed your basket, you must:
1. enter your personal information;
2. accept the general terms and conditions of sale by ticking the box;
3. select your method of payment;
4. pay for your order, which legally finalises the purchase agreement made with RD.

RD takes great care when putting information online with respect to the essential characteristics of our products, notably with respect to the technical descriptions and the photographs illustrating the products, within our technical limits. The photographs illustrating the products may differ from the shipped product so no claims can be made based on photographs.
All offers are valid while stock lasts.
The prices indicated on the Website are in Euros and include all EC taxes but do not include delivery cost and do not include duties for countries outside the European Community. The possible delivery costs are indicated for you during the product selection and are invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the Website at the time the order was placed.
All our prices are the same for EC and non-EC delivery addresses with the exception of CH, NO and IS (see 4c), only the price when shipping within the EU includes 21% VAT and shipping outside the EU includes 0% VAT. Reason is that for outside EC shipping we only charge €15 while the actual cost is a multiple of this amount. Also it takes us considerably more time to ship a non-EC shipment because of the paperwork involved. To keep things simple for us and the customer we therefore chose to use one price throughout the website for all destinations. This means that for deliveries outside the EU no VAT can be reclaimed.
For deliveries Switzerland (CH), Norway (NO) and Iceland (IS) we make the following exception: on orders with a value of more than € 250 we will deduct 21% VAT on request and we will increase the shipping costs to € 50. This amount will lower the end price for the consumer and we also list this price on all customs and invoice documents with the shipment. The price difference is refunded to the bank account of your initial payment. Reason for this exception is the lower shipping costs to CH, NO and IS compared to other non-EC countries. We apply this exception since 2017 (Iceland 2018) and we do not apply retrospective refunds from before this period.
Please note that we will honour your order while stock is available. In the event where one of the products ordered is not in stock, we will contact you by e-mail in less than seven days as of your order date to inform you how long it will be before we are able to deliver the product.
If there are certain products that are temporarily unavailable, we will send the available products and will pay the shipping fees for the rest of the order. We will offer you a replacement for an unavailable product. If you choose to refuse, we will reimburse the unavailable product. If you wish to return it to us in the conditions outlined in article 8 (right of retraction – returns), the fees will be covered by us.

RD offers the following methods of payment: Mastercard, Visa, iDeal, Sofort Banking, Giropay, Bancontact, PayPal and bank transfer.
Depending on your payment method a delivery delay of several days may arise, because as long as your payment has not been debited on the bank account of RD, your order will not be processed.
For payments made online by credit card, the “Secure Socket Layer” (SSL) system of security is used, which allows for encrypting your banking information when on the network.
RD allows you 14 days to return a product that you are not satisfied with.
Your right of retraction starts from the moment your order is delivered and you can return the product(s) within this time period, accompanied by your invoice and a print-out of the return confirmation e-mail from RD.
The right of return only applies to product(s) that are in ‘as new’ condition, complete and that have not been used. It should be returned in the original box you received with it.
If you want to use your right of retraction, RD will reimburse within 14 days after your call for reimbursement. However we reserve the right to use 3 working days to inspect the returned product(s) after receiving them.
RD recommends that you send us the product(s) by registered post and that you purchase insurance with the carrier for the value of the product(s). This is notably necessary should they lose or damage the goods.
Shipping fees and risk remain your responsibility, except if the product(s) is not conform to its description.
All products sold by RD come with a legal guarantee concerning product conformity and latent defects, as outlined in the following legal clauses.
You should notify RD of any non-conformities within a laps of two months after the product is delivered. You should notify RD of any latent defects within a laps of five years after the product is delivered. After mentioned lapses RD does not accept any responsibility for effects of non-conformities or latent defects.
Whatever the problem is with your product, you must attach, with the defective product, a copy of your invoice and a print-out of the return confirmation e-mail from RD.
Shipping fees of the products are your responsibility. However, if the product does not conform to the product description, shipping fees will be reimbursed to you only if you respect the delays mentioned above. You can return the product to us by mail or any comparable shipping company. RD will then do any necessary repairs.
Legal guarantees do not apply to repairs for damage caused by external origin (for example an accident) or by non-conforming, harmful, commercial or community usage.
All products sold by RD come with a 5 year limited warranty. This warranty does not cover normal wear and tear, zippers and fabric coatings and damage caused by an accident caused by you or a third party and damage due to harmful, very intensive, abnormal or non-conform usage of the product.
RD determines whether a default is covered by warranty or not and whether it will be repaired or replaced.
In the event where RD will not provide service under warranty, an estimate of the cost of the repair will be given to you. If you agree to the estimate, repair/replacement will be done after acceptance of the estimate and reception of your payment. Administrative fees may be charged if payment for the estimate is not made.
RD will not be held liable for poor use and its consequences on the products purchased from the Website. Although our products have performance that is compatible with professional usage, the Website does not sell products for professional usage.
RD will not be held responsible for consequences on the purchase, delivery and product resulting from a force majeure and in case of mistake of the customer of resulting from actions of a third party.
